Medical Malpractice Topics

Erbs palsy is a common form of brachial plexus palsy. The brachial plexus region of the body is found in the neck and shoulders and is a bundle of nerves that runs from the spinal cord into the arms. Erbs palsy is an injury to the fifth and sixth cervical nerve of the brachial plexus region that causes impaired functioning of the upper limbs. Erbs palsy is acquired by a newborn in a difficult or long birthing process.

The risk factors for Erbs palsy that can occur during delivery include fetal macrosomia (a condition where the baby weighs more than eight pounds fourteen ounces), maternal diabetes, obesity or short stature, a broad or flat pelvis, breech birth, forceps or vacuum delivery procedures, maternal weight gain of 35 pounds or more, and the use of labor inducing medications. These factors all increase the likelihood of shoulder dystocia.

There are four types of brachial plexus injuries that can cause Erbs palsy. In avulsion the nerve is completely severed from the spinal cord. Rupture is also a tearing of the nerve, but in a different region than the spine. Praxis/stretch is when the nerve is injured or damaged but not torn. A neuroma is when scar tissue develops around a nerve during the healing process. This scar tissue prohibits the nerve from sending signals to the arm.

The symptoms of Erbs palsy are generally quite obvious. A child with Erbs palsy may have decreased sensation in the arm, lack of muscle control, or partial or complete paralysis in one limb.

Recovery from Erbs palsy is possible in some cases. Early intervention through physical therapy can greatly increase the chances that Erbs palsy will improve. Experts have found that Erbs palsy patients who heal significantly by one to four months have a strong chance at full recovery without the need for surgery. If the Erbs palsy patient shows no significant recovery after four months, healing is not as likely and may require surgical intervention. Surgeons will often recommend waiting until the Erbs palsy patient is four or five months old to consider surgical options.

Erbs palsy can be the result of Medical Malpractice in Miami during the birthing process. There are several things that a doctor can do or fail to do that increase the likelihood that a baby will suffer Erbs palsy. If Medical Malpractice in Miami is the cause of Erbs palsy, the victim has the right to seek compensation for the damages they have suffered. Damages can include medical expenses or future surgical expenses, pain and suffering, and in cases where permanent or partial disability results, damages for the loss of future income can be recovered.
